Este artículo expone cómo en España los poderes pú-blicos tienen obligación legal de respetar el ejercicio de libertad que supone el inicio de una nueva actividad empresarial. Para que el derecho a la libre empresa resulte efectivo, es necesario que el marco legislativo tenga una cierta estabilidad. El derecho a la seguridad jurídica está garantizado por la Constitución de Espa-ña, y vincula a todos los gobiernos y administraciones españolas. El artículo hace distinción entre el concepto de buena administración, buen gobierno y buena le-gislación.

This article shows how in Spain the public authorities have the legal obligation to respect the exercise of freedom that entails the start of a new business activ-ity. For the rights to free enterprise to be effective, it is necessary that the legislative framework have certain stability. The right to judicial security is guaranteed by the Spanish Constitution and links all the Spanish government and administration. This article does a dis-tinction between the concepts of good administration, good government and good legislation.
